I don't know the whole story about it but I do appreciate the poem. Still, whatever happened, if a person who is incarcerated attempts to escape and kills someone in the process, it is their fault (whether they meant to kill someone or not) and they should be punished accordingly. Their action caused a death, either directly or indirectly. If he wouldn't have tried to escape, the warden would still be alive, correct? While there are differences between murder and manslaughter, based on intent, a death is a death. Whether the intent is there or not, the possibility is. If you drive drunk, you know there's a possibility of killing someone. If you go in a rob a store using a weapon, you know there is a possibility you might kill someone, etc. If a person kills someone while that person is conducting criminal activity, the punishment should be greater than that of just an accidental killing. |
