Ron, admins, and mods: Today, Sharon and I were talking over ICQ, and she mentioned heading to Yahoo! and typing my name in the search window, just to see if my pages at Passions popped up first. They did, as well as a few other links that I did not recognize. Upon following them, I found some of my poems, on sites, without my permissions, though credit was given. At one site in particular http://www.getpassionatenow.com/gppoetry.html all the authors of the poetry linked back to netpoets.com. I don't recall ever being asked by this site to use my material. Now, I don't mind the exposure, but I am a little irked by the lack of common courtesy. Any and all opinions/insights would be appreciated. I would also urge ya'll to do a search on yourself, just to see what pops up. http://www.yahoo.com or whatever search engine you prefer. I've found several others using our members poetry but am not sure if they gave permission. One poet (a newbie named Ron Carnell) has his poem 'Cyber Seas', as an internet greeting card...needless to say, I sent Ron an email. And I wrote a letter to the site that was using Alicat's poem. I think this thread should be moved into the Alley, so ALL of our Members can benefit from it. FWIW, getpassionatenow.com and asandboxgreeting.com are, in some obscure way, related to each other. The former is registered to Ann LeVassuer in Westland, Michigan and the latter is registered to Sandra B, also in Westland, Michigan. Coincidence? Maybe, but the billing contact for getpassionatenow.com is listed as S.B., too. Everyone knows how strongly I feel about the importance of getting permissions before using someone else's work. We have a right to know where our words are being displayed and what mental relationships are being formed as the result of that display. This could just as easily have been a porn site. I suggest writing the individual responsible, making it very clear that permission was never asked nor given. Cite the page, but also mention the domain name very prominently AND CC your letter to the web host. You will likely get a fairly quick response. I agree Ron, and thank you deVine for moving this thread from Mod to the Alley. Ok, members. Sometimes it is best to err on the side of caution, so I would urge you to do a search on your alias and copyright name, just to see who has you linked where. If the site is one to which you gave posting permission, fine and dandy. But if not, let us know. We'll all try to help you resolve this issue. Try searches at Yahoo!, Excite, Dogpile, etc., then post the link in your reply using 'a href' or UBB url code. (Both examples can be found in the Member's Help Area). If you know of someone here who normally does not leave their particular forum, send em this post, give em a clue. Good huntin! Alicat |

Allow me to apologize for any sensationalism this thread has caused. quote: This quote can be found on any poetry page at netpoets, and keeping that in mind, getpassionatenow did not violate this clause. However, there are still others out there, who include the poet's name, but fail to link back to the PiP page URL. This does not negate the issue of common courtesy. I still hold that the poet should be contacted and permission granted before their work is posted elsewhere. So before anyone goes ballistic, check to see if the site in question links back to the page url, as well as giving credit. I found one of my poems -- the only one I submitted to the main site -- posted on a DATING PAGE ... *Linda reels dramatically* Anyway, this is the site: http://www.tolove.com/poems1/lifepoems1.php3?messageID=18 Apparently it was posted there by someone called "Love Guy," without my permission! I think it's interesting, Becky - that first link you found has this at the bottom of the page: All Rights Reserved. * No Mirror Sites Allowed * It seems they want to protect their rights, even as they are abusing yours. I couldn't find a email address on the second link either, but I did find her son's web site at http://deermaster8.homestead.com/MyHome.html - I suggest you go there and post a note in his Guest Book. She also has a five-year-old daughter with a site at http://breeleigh.homestead.com/Home.html and there's a guest book there, too (and one would assume Mother is managing the site). Your first example is a bit irritating, since they effectively tried to put a copyright on your work. The second, I think, is an example of a very nice person just not realizing she's made a mistake. |

It's astounding to me how widespread this is becoming - Perhaps I'm protective of the Passionate fold here, but one of these sites didn't even bother to be very original about their name.... This doesn't please me... and Ali - I don't see it as sensationalist at all... |

Ali, I have to admit, I didn't realize that wording could be construed to suggest contacting the author was optional. But you're right. That's exactly what it says. I'll be changing it as soon as possible and certainly by the next update. I have to admit, I'm a lot less concerned with individuals posting my poetry on their personal web site than I am with companies using it to further their own agenda (like the first two links Sharon posted). If they have a free web host and their site is strictly personal, I will probably lodge no complaint at all. I'm pleased they enjoyed my words enough to want to reference them frequently. But those who have their domain and, seemingly a company name as well, should know better. If my sister borrows my car without asking, I'm not going to be happy. But I won't immediately call the police, and will assume there was a reason for her uncharacteristic actions. If someone down the street takes it to deliver newspapers, however, I'm going to make very sure it doesn't happen twice. Logically, I know there's not difference between the actions, regardless of who does them. Emotionally, there's a huge difference. My point is, those words you quoted really haven't changed in over two years. They are almost word for word what was posted when I first uploaded a handful of my own poems. At the time, I suspect I envisioned a bit of a different destination than the one netpoets.com has since found. I guess this is a wake-up call for me and, in retrospect, I see I should have done much more to protect our authors. It's time, I think, to educate those who are visiting Passions. |

Thanks for bringing it to our attention Ali. I used to stay on top of this, but hadn't done a search in months. It was pretty interesting. I've given permission to only one or 2 "personal" sites and I have copies of me giving my permission to them so I could validate later if I ran across "me" somewhere, LOL. I do not believe I've been approached by any of these though. I'm glad you wrote and explained a little of the situation to me. As I said in that thread, I'm less concerned with people using my poetry (yea, you have one of mine, too :-) than I am with commercial sites abusing it. Your explanation goes a long ways towards allaying some concerns. But, of course, I can only speak for myself, not Marge or anyone else. Here's two possible suggestions. First, as time permits, I strongly suggest you give the authors more credit. For example, Marge's byline is way down at the bottom of the page, in fairly small type, and easily missed. Nor is it even obvious the name is a link, not unless someone just happens to run their mouse over it. People want to be recognized for their contributions and, as the web designer, it's up to YOU to make that recognition meaningful (rather than just token accreditation). Does that make sense? That's going to take some time, of course. In the meantime, more immediately, I suggest you register in the forums and post a response to that thread. Be as honest and open as you were to me, and I think you'll be very surprised by the results. We have some of the most caring and compassionate people in the world at Passions, and I very seriously doubt anyone will take you task for making a simple mistake. Promise to make the correction above, and promise in the future to contact the authors before posting, and I suspect you'll not only allay their concerns - but will also gain some loyal visitors. Sven, I went to yahoo and typed in WhtDove and clicked search. I showed up of course in Passions, but also other sites I had no idea were using my poetry. You don't need to do anything else but type in the name you use. If you have poetry on the MAIN site, that's where most of them are being taken from. You can then at the bottom of the search page, click another search engine and search different sites. |

What you're finding, of course, are only those site that have, at least, attributed the poem to you. You might also consider searching for sites that have posted your poetry without even giving you credit. Instead of searching for your pen name, search for the first line of a particular poem. You can also bypass Yahoo if want to save a few seconds. The results don't really come from Yahoo (which is a directory of reviewed sites), but rather from Google. Go to http://www.google.com/ and you have a little more control over the search. |

I will Kit...started out nicely. Then as my 'dander' got farther and farther UP, I got more curt. Actually what I'm doing is emailing the offender AND the site host..most of them are Tripod or Angelfire. I found one of Michael Anderson's (More) and cc'd him as well. So far, I've only gotten one returned email, but there was a second one on the site so I used that. Where there is a guest book, I've signed with a note "Lover's Dance is copyrighted to me, it's author. Please remove it immediately. Email to follow." I even found a story that contained my poem..the character in the story was reading it. But at the end, I was given full credit with a link to my email address, so that too was let go... If just the few poets here have these many problems, I wonder what the whole of Passions would find if we searched. I think we should write something up for the next newsletter - what do you think Ron? |

I think that would be a great idea, Sharon. I think it might also be useful to document some of the results we've seen here, too, which might help to discourage it from happening as often. This is one of the reasons why I really discourage people posting "Author Unknown" posts in the forums. While I'm sure our people really believe the words are anonymous, there's just too much chance this same type of thing happened to someone else out there. All it takes is one uncredited post somewhere and all of a sudden the words belong to "Author Unknown." As you're emailing these people, it might be well to consider that at least some of them may have fallen into this same trap; i.e., they saw the poem without a credit, liked it, and posted it the same. |

Well, I've dug out my Sherlock Holmes Junior Detective Kit and am hot on the trail! To Whom Funds, I have been following this post and I think it is very sad that people would do such a thing but nothing any more surprises me, It was mentioned that most of the poetry used was on the main site but im sure if there finding stuff from there then they have also come in to the forums looking, what im asking is if one of you comes across poetry done by other poets here are you e-mailing them to let them know? Im not to good on doing surches, I did find that there is someone out there by the Cerenity going to school and has some poetry on the inter net,there of all things is a bed called Cerenity, and there is also a famus women who is passed away now but has my real name and she is all over the inter net, thank you. I have a question regarding this topic... Are majority of poems 'taken' without the permission of author from the forum pages or are they from postings at the main PIP site? I ask this because I've never posted at the PIP main site and I'm sitting back today wondering whether it is there the 'culprits' take these treasures from... ~coco~ |

By and large, the poems used are coming from the main site, with most of the borrowing sites adhering to the letter of the original copyright notice, which Ron has since amended with the author's permission to be requested for use. However, there have been a few sites out there that borrowed from the forums, and linked back. This is very easy to find, if you click on the link and it gives you a 404 at netpoets. (The forums, now on Athena, were, until recently, on Ceres. Hence, the page will not be found on Ceres.) Another possibility could arise from a prior posting at another UBB or BBS, or even on a personal website being borrowed. [This message has been edited by Alicat (edited 03-04-2001).] |

I have tried to be cautious with the poems I post at Passions' forums, only because I know how easily they can be taken and used without my permission. I searched at several seach engines for "Lakewalker" and was amused to fine my posts at another message board that I used to visit (oh the memories), my poem in passions's poetry magazine, and listings on eBay for the LakeWalker knife set (I think I need some now ). I have not submitted any poems to the main site, that may be why I haven't found any of my poems used without permission. Thanks for bringing this subject up! Groan ... I'm tired. This is really quite sad, and never-ending it seems. Each search is a new adventure (and I'm only focussing on the one's who don't list me as the author or list themselves) ... sigh. Here's a brand new poem someone created which is a compilation of about 3 of my "dog poems", phrases and lines taken from several verbatim and rearranged into one brand "new" poem entitled "Buffy" pulled together by a 16 year old girl. How do I deal with this one? Any ideas? I do not wish to terrify a young child with legal wording by any means. I also want it deleted. Seriously, I receive so many wonderful e-mails from the main site almost daily, that it suitably out-weighs the problems I'm finding, though I'm still completely aggravated. I've come across a lot so far that are real issues, and I'm not done by a long shot. I did just receive a very apologetic letter from one person, which I very much appreciated (and thanks for passing along that other one Ron). |

However, I did a search on "suthern"... and was quite shocked to find a poem called "Reality" on the main forum submitted by suthern on 12/12/99... and that isn't me or mine!!! |

I received another email telling me the webmaster removed my poem, but also stated that she has seen it ALL over the Net without my name or with someone else's. Sigh. It's nice they like it so much, but wish they would give ME credit and a link. |

Hi everyone! I've spent the last 7 hours going through my site (and Anns site) and making corrections. All links are now either above or directly below each poem, and in larger print. Hopefully I have not missed anyone...I had three years worth of pages to wade through and may have missed one or two : ) I did not know anyones web site addy but will be happy to add it with the net poets link if anyone wants to send them to me. I agree with you, Sandra. All things do happen for a reason, though we may not always understand the why. Once you catch your breath, take a good look around. This place is a LOT bigger than it was even a few months ago, with 5 distinct main categories, all with their own subcategories. I think you'll like what you see. Ron has put a lot of himself into this site, as have all the members. And, if your fresh eyes see something that could be improved upon, don't hesitate to drop a note in the Suggestion Box. In other news, I've finished sending off the rest of the emails. Now, I've just got to wait. Ron, I bcc'd one of em to you....for the site I posted earlier where no credit was given at all. Mike, you may want to search for 'Robot' too.. and when someone finds a site like Mike did, we all need to take some time to look at it to see if we recognize any of the poems. You never know, something may have been missed by the search or someone could change a couple of words that would negate the search. |

LOL Here's the email I sent: Hi, I was doing a search on my poetry today, and came to your site. I see someone by the name of "goofy," borrowed my poem "Look Within" and posted it on your board. I have to give applause as they actually did give me, the author, credit to the poem. However, permission was not asked of me to use it, nor was a link provided to where they found it from. Passions in Poetry I would appreciate if this member was notified of that, and asked NOT to post poems of another author unless permission was asked to do so. Hi All! I decided to do a search for one of my poems on yahoo and I found a number of sites using it. Only one site gave me credit and a link back. Two others claimed to have written it themselves. One guy posted it as an tribute to his wife and won an award for it lol! I'm afraid to look for any of my other poems! |

This is the Love Police… I am concerned about this criminal activity that’s going on around the Internet and I suggest that YOU take immediate action to make people aware that the original poets of stolen passages are seeking these criminals out. Justice shall be served!! sans38…the one guy who received an award for your poem, was that a contest? I’m sure the other competitors would be pretty upset to find out they lost to someone who cheated! He should be striped of that award, are you going to do something? Otherwise he may find his way here at Passions and do the same thing to one of our fine poets. Hi sans38 (Sandra) Hope I didn’t scare you! Ha! I am just another poet here at Passions that created this cop character to give my fellow friends here a smile or a laugh just to make their day go a little better. The Love Police can’t really take legal action anywhere because he is just a character bound to Passions. This family of friends at Passions also like to have fun too, so make sure you stay awhile and have some fun with your writings? |

I just responded to an email from Rebecca at dreamersreality.com (see Elizabeth's post), and she is definitely pursuing the matter. She wrote me because she didn't really know whom to believe - a regular contributor to her site or a stranger she just "met." She asked if we could compare submission dates to see which author posted first. I pointed out to Rebecca (and am reminding everyone here) that the Response Panel following every poem at the main site includes a "More" button for reading more poetry by the same author. And included on the Author's Page is the exact date the poem was submitted to Passions. When you're emailing these people, it might be prudent to include a link to your Author's page as well, so they can see that date. I think it's also a little more convincing when you can include a precise date in your letter, rather than an approximate one. BTW, Rebecca sounds like a very nice person, who just wants to do the right thing. |

OH MAN I just did another search and hit the mother load so to speak. I ran the first line of a poem of mine and when I went to the site found not only 3 of my poems but 7 pages of lists of poems I have read at the Passions main site. this is the url of the page I started at with my poem http://library.lovingyou.com/poetry/24/24602.shtml then I just followed the link for more poems by this author http://library.lovingyou.com/utils/poetry.cgi?val=Goldene I could not believe that there was 135 poems this woman claimed to have written! Perhaps she did write some of them but I know the majority of them were stolen from others. |

Yes, the admin of the board removed the plagiarized work when one of the poets posted a response to her OWN poem. :-) I certainly appreciate your quick response. I'm writing again because many of our poets have recently started using search engines to find instances of "borrowed" work, and the ezboard system seems to come up fairly frequently. So far, our poets have had little difficulty getting their poetry removed, but they are complaining about the attitude they are seeing. I know your TOS includes this language: "You agree to not use the Service to: …infringe the rights of any third party, including but not limited to intellectual property rights and privacy or publicity rights," but we're finding that some of your people apparently don't understand what they have agreed to follow. For example, Tempered Steel < Grabowms@aol.com > at the Steelville board mentioned in my previous email, responded with the following (copied verbatim) : "Copy rights... on the Internet, as long as proper author identification is given, (or as best can be achieved) I believe it is not a copy right violation, but will admit, it is pushing it. It falls under public domain." This person obviously doesn't understand that something published with proper accreditation, and especially with a copyright notice, is NEVER in the public domain (at least not for the next 70+ years). We appreciate that Tempered Steel removed the poetry, and we know he can't be expected to recognize everything his members post as original or stolen, but we do not appreciate him trying to argue the laws involved. His ignorance of what constitutes intellectual property rights suggests a problem that, while resolved for now, will only result in further violations. The admin of this ezboard was polite and helpful, but should be made aware of his responsibilities. The admin at LatinaBarbie < http://server3.ezboard.com/blatinabarbiesmessageboard.html > was equally ignorant of the laws involved, but considerably less polite. Michelle Curiel's < michelle@latinabarbie.com > response to one of our poets was: "I have no problem deleting your poem, as it does not affect me and i'm sure people on my board will not miss it either. This is the first time I even see your poem. Can I have the link to where this poem is at so I can delete it "IMMEDIATELY!" "I understand you have your rights, but as much as you have your rights, people have the right to post things such as poems they have found on the internet on boards, etc. It is not as if he is using your poem for money. And it is not as if he is using your poem on a website. It clearly states '(c) 1999-2000 WhtDove Please respect the rights of the author and Passions in Poetry. If you would like to use this poem on your own web page, please use the Mark button. Thank you.' "They said webpage, not message board. They are two different things. If you don't want people copying your poems, then i suggest you not post them on the internet!" Jeff, we don't expect your users to be lawyers, but we do expect them to be aware of their responsibilities. We don't expect them to be omnipotent, but we do expect compliance and common courtesy. Passions in Poetry gets just shy of two million visitors a month, and all of our poets KNOW their poetry is going to be shared by many - but nonetheless wish to maintain control over where and when that sharing takes place. That's their right. The admins of your software have agreed, through your Terms of Service, to support that right. I think your company has a responsibility to insure they understand what that means. While ezboard might wish for the traffic of Napster, I'm sure you don't want the reputation. Thanks for listening, Jeff. I will soon be adding software to Passions so that any of our poets or visitors can report copyright violations for follow-up activity, and I hope I can count on your help should the ezboard name again surface. Hi fellow poets, I am one of the owners of a web site found to have a plagarized poem on it. This one was a pretty obvious plagerism not just a simple sharing of someones poem. I will also add I have removed it. I feel bad that it happened, but better that it was caught. I brought this same subject up with a newsgroup I belong to for their opinions and thoughts. There are a lot of fellow writers in this group. They are more geared toward short stories but their feelings have been very much the same. It seems some Website owners are unfamiliar with the laws and rules regarding copyrights. Your poems do belong to you whether a formal copyright with the Office of Copyrights is pending or not. Just putting your your words in print is enough for it to be copyrighted. But providing proof is where the copyright comes in. An official Copyright is not really that expensive $30 and you can copyright all your poetry in one lump some as a "collection" or "works of" or individually whether published or not. It lasts your lifetime +70 more years. It is an easy to understand form that can be printed out on your computer. Prior to posting any of my poetry on the internet, as a Canadian, I filed with the CIPO (Canadian Intellectual Property Office), and have a Copyright Certificate of Registration, which covers a compilation of my writings. The cost at the time was $65 Canadian. It simply gave me an added layer of protection and comfort prior to posting my work on the internet, in anticipation of what we are discovering. Heh..that got me too, Elizabeth. Well guys, I downloaded Copernic 2000 from download.cnet.com and I've gotta say that I love this thingy. Sure, it's a little bulky and is a little bit slow, but I've found a few of mine I missed before. It searches AltaVista, AOL, Direct Hit, Euroseek, Excite, FAST, FindWhat, Go, Google, GoTo, HotBot, LookSmart, Lycos, MSN, NBCi, Netscape Netcenter, Open Directory Project, Webcrawler, and Yahoo!...and that's just for web searches. Exact phrase matching, and groups identical hits together, instead of listiing them separately. This should make this project just a tad easier.... |

Uh, PdV & Balladeer, In reading this post I was not surprised to see EZBoards name pop up. My question for either of you is, with whom were you able to contact at the EZBoards to get something done? A user there, "Nox", has posted one of my poems under his name... I have emailed the administrators, I have left my own personal message on the boards, and I have used their user complaint link to file a formal complaint. I have heard zilch. I noticed this user had actually won an award for his poem "Lover's Dance". Was this a dupe of your poem, PdV? Just curious if this guy has done this before. Michael |
