When a work is published in various anthologies for educational purposes (as in text books) does this negate or otherwise alter copyright laws/protections, or do such publications make them freely accessible for use in say, thesis papers, which might possibly result in further publication (such as magazine articles)-- as long as all proper sources are cited? |

Generally in such papers, the content of the cited piece is summarized with annotation pointing back to the original source. Small sections are allowed to be reprinted under Fair Use, but anything more than a few lines (properly annotated) is going to get the paper or work disregarded by peers and instructors since the entire purpose of those assignments is to enhance critical thinking skills, cognitive reasoning, and to provide fresh (or less than stale) insights into a single work, or an author's body of work if they have a trand or theme. But then there's those, even famed published fiction authors, who lift whole chapters and sections, never cite the source, then get in a self-righteous snit when their creative editing is scrutinized. As far as I know, there's not a Muse for Copy-n-Paste. |

Proper citations, as are often used in briefs, are required so that when one must read a whole case, can be pointed to the correct text. This is what I use as a guideline when quoting from some other source. Trust me, it does not negate copyright laws, rather, enforces them. In anthologies of past works being used for new resource material, all matters referred to generally have a section of their own. Even a thesis would refer to those points borrowed. At least, this is my understanding at present. And I have to smile at Ali's almost-muse.  |
