Should the intent of the original lawmakers
be critical to the decisions of the Supreme Court
or should it be at liberty to reinterpret the words
so as creates regardless a new understanding
and new law?

Dear John,

          When you demand a yes/no answer to a question  with a spectrum of plausible, and responsible answers you are attempting to create a false dichotomy.  This is a form, I believe, of "begging the question," which demands an answer based on a debatable or even false premise; by giving any answer at all, it sounds as though you agree with the premise.  Ron has given you one of the few sensible answers that taste allows.  Why do you find that upsetting?
