Could Be Anywhere...

Is anyone aware that this site is openly stealing the poetry from Passions and displaying it?  Their
disclaimer states they believe the poetry is in the "public domain" yet also states it has been drawn from this site. Everything on this site is clearly labeled copyright reserved is it not?

thank you - i'll hold off on any action in the hopes that we can address this in a concerted manner if possible. i've allowed several people to use my poetry on their site, but i'm sure this isn't one of them.

Checked it out - mine are not there, nor my daughter's, however, I really do think that the people from PIP that are there should really raise some heavy duty cow-patties on them and go "Splat".  (I'm trying to be polite here!

If your poem is on this site, it appears that they've given you credit for having written it.  That's a good thing...

If they didn't ask your permission to use it, that's a bad thing...

If you want your poem removed, you should contact them directly.

Follow Kit's advice - She's done a lot of work on this issue...

If they do not comply:

I've had a few times when I didn't receive a response or action within a designated timeframe using a similar letter to the above, and the poems were still up on the net (always make sure your screen is refreshed just in case you're looking at a cached image though).

In those cases, I have forwarded the note to the same person again, adding:

If they still do not comply OR if you can't find an e-mail address to the poster:

You'll need to be able to identify the service provider of their site, see if they have a specific e-mail address that would best suit this type of problem, and if you don't receive a response in 24 hours from the first person in question, forward a copy of your e-mail, with a cover note to the service provider (and cc the first person).  Here is a copy of a note I have used to the service provider:

Some service providers require more detail:

The reason I came up with the blurb above, was due to a response I received from Lycos in one situation. I thought I'd copy it here, so you are aware of what some of the larger service providers ask of you before addressing the issue. (I also include a scanned copy of my copyright certificate, which I signed and blocked my address from.). The following is a letter I had received when I reached Lycos on an issue and didn't provide enough detail for them. If you don't have a copyright certificate, you could use the rest of the wording, and just eliminate that part, as it should hopefully be enough to convince them.

6.  A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right is allegedly infringed.

You have not provided all of the information required above.  If you are able to provide the missing information, please submit an appropriate notification meeting all of the above requirements to Lycos Inc.'s registered agent for receiving such notifications:

I would like to make a further observation about sites like the one mentioned above.  I know from experience how hard it is to get some of these sites to pull your poetry... especially when they don't give the author proper credit.  The author of the poem "Daddy's Day is an aquaintance.  Cheryl Costello-Forshey wrote this poem well before 9/11  and it was published in the second edition of Chicken Soup for the Soul.  Since 9/11, it has appeared in a variety of forms, some with an additional stanza referencing airlplanes hitting buildings.  and most of these are without proper credit and copywrite given.  Since discovering these infringements, she has been campaigning to get several of the sites she knows are using  it to giver her proper credit for her work (one even had the audacity to pass it off as his own and try to sell it on a self-made cd) and to remove the 9/11 referenced stanza.  The more sites that your poetry appear on without your consent or credit, the easier it is for someone else to claim it as public domain or worse yet, claim it as their own original work.  It is a horrifying fact of cyberlife.  Daddy's day is now become so popular that it is listed in the Urban Legends and Folklore site as one of the most popularly ripped off and abused poems. I thank God for places like Piptalk where everything I write is automatically logged and copywritten.  I safeguard my poetic works this way.  And on my own website, I java impose a no-right-click script that instructs those who would to please email me for permission rather than acting like little theives. nuff said...  I checked the site... they haven't got any of mine....

I didn't find any of mine but I did find one of Rons as well as some of the other names of Passions Poets!!  Any updates on this yet anyone?

I was appalled at the blatent thefts, and the connection with psychic readings, tarot cards, flower sales etc, in the guise of it being somehow associated with Ron Carnell and Passions.
